Agreement to Terms
By engaging our services, you acknowledge and agree by these terms and conditions, including any additional guidelines, policies, or instructions provided by the Tutoring service which may change from time to time. It is the client’s responsibility to carefully read and understand these terms before proceeding with our service. If you do not agree with any part of these terms, please discuss this with us so that we may look to find a remedy to the situation. We are here to work with you.
Scope of Service
Our Tutoring service aims to provide comprehensive academic assistance and support to students in specific subjects or areas as agreed upon between the Tutor and the student/parent. Our services are designed to supplement and enhance the student’s learning experience and academic performance.
Our Tutor will work closely with the student to understand their individual learning needs, goals, based on IGCSE/GCSE, British, IB, American, NSW, & CBSE Curriculum requirements. Based on this information, the tutor will develop personalised lesson plans and teaching strategies to maximise the student’s understanding and progress. Our Tutor may provide instructional support, review and clarify concepts, offer practice exercises and assignments, provide feedback on student work, and offer guidance for exam preparation and study techniques. Our Tutoring service may also include periodic progress assessments and feedback to track the student’s improvement and identify areas that require additional focus or support – this would be discussed with the parent/guardian to ensure support and feedback is provided. While we will make every effort to assist the student in achieving their academic goals, it is important to note that individual results may vary, and the Tutor cannot guarantee specific outcomes or academic success. Our Tutor may recommend additional resources, study materials, or educational tools that can further aid the student’s learning process, but the acquisition or use of such resources is not included in the tutoring service unless specifically agreed upon separately. By engaging in our service, you acknowledge and accept the scope of service described above, and you agree to collaborate with the Tutor in a constructive manner to facilitate the best possible learning experience for the student.
CODE OF CONDUCT & WAYS OF WORKING
Our Tutor agrees to maintain a high level of professionalism and integrity throughout the Tutoring relationship. We will arrive punctually for scheduled sessions, prepared with appropriate teaching materials, and ready to provide focused and effective instruction. Our Tutor will respect the student’s individuality, academic needs, and learning style, adapting their teaching approach accordingly to foster an optimal learning environment. The student and parent/guardian agrees to approach the Tutoring sessions with a positive attitude, preparedness, and a willingness to actively participate in the learning process. They will complete assigned tasks and exercises to the best of their ability and seek clarification when needed. Both our Tutor and the Student/Parent/Guardian will communicate openly, honestly, and respectfully. Any concerns, questions, or requests for adjustments to the Tutoring arrangement should be addressed promptly and directly. Confidentiality is crucial to maintaining trust and privacy. Our Tutor agrees to keep all student information, academic records, and any personal details shared during the tutoring sessions strictly confidential, unless required by law or with explicit consent from the student/parent. Any form of inappropriate behavior, harassment, discrimination, or disrespectful conduct will not be tolerated. Both our Tutor and the student/parent should treat each other with dignity and respect throughout the tutoring relationship. In case of any grievances or disputes, both parties agree to engage in open dialogue and make reasonable efforts to resolve the issue amicably and in a timely manner. If, at any point, either party feels uncomfortable or believes the Tutoring relationship is no longer effective or beneficial, they may discuss the matter and decide to terminate our services by providing appropriate notice as per the termination clause outlined in the terms and conditions. By engaging in our services, you acknowledge and agree to abide by the code of conduct outlined above. It is essential that both our Tutor and the student/parent adhere to these principles to foster a positive, respectful, and conducive learning environment.
Cancellation & Sessions
At Cerebral Tutoring, we strive to provide our students with the highest quality education possible. We understand that life can be unpredictable and that cancellations may be unavoidable. However, to ensure the best experience for all involved, we kindly request that you provide us with at least 24 hours’ notice if you need to cancel a session. In the event that notice is not given within 12 hours of the scheduled session time, the full session fee will be charged. We recognise that unforeseen circumstances such as illness or emergencies can arise, and in these situations, we ask that you contact us directly as soon as possible. Although we maintain the right to charge for the session, we are usually happy to reschedule at the next available time slot. If you plan to be away for an extended period, please inform your assigned administrator at least 2 weeks in advance. Likewise, if your Tutor plans to be away for more than 2 weeks, we will notify you in advance. If you no longer require our Tutoring services, please let your assigned administrator at least 2 weeks prior to your proposed final session. We ask that you kindly avoid canceling sessions last minute, as we invest a significant amount of time and effort into preparing and planning for each session, long before our students arrive. At Cerebral Tutoring, our goal is to work collaboratively with you and our students to ensure the best possible outcomes. Payment & Invoicing Terms
At Cerebral Tutoring, we are dedicated to providing the best possible educational experience for your child. To facilitate this, we kindly request that payment be made in advance at least a day or two before your tutoring sessions begin. The Parent/Guardian agrees to pay our service provider the agreed-upon fees for the Tutoring services scheduled. The payment amount is required in advance before the first session if it is a Term booking OR before the session commences if it is a single session OR within 3 days from invoice issuance – whichever is sooner. The Parent/Guardian shall ensure that the payment is made by the specified due date to avoid any disruption in the Tutoring schedule. All payment details, including fees and payment methods, shall be outlined in a separate agreement or invoice provided by our service. Our service may revise the fees and payment terms with reasonable notice to the student/parent. Any changes in fees or payment terms shall be communicated in writing. The Parent/Guardian understands that any additional materials, resources, or study materials required for the Tutoring sessions may incur additional costs, which will be communicated in advance. Refunds for prepaid Tutoring services are subject to the discretion of the provider. Refunds may be considered in exceptional circumstances, such as prolonged absence due to illness or other justifiable reasons, and will be determined on a case-by-case basis. However if payment is made for the term – we reserve the right to not refund as we have reserved the booking for the term. The Parent/Guardian shall promptly notify the our service of any discrepancies or concerns regarding the payment details or invoicing. Any disputes regarding payments shall be addressed through open communication and efforts to resolve the matter amicably. We offer the flexibility of bank transfers using the provided pay ID or through the issued invoice link, as well as PayPal. Your prompt payment helps us maintain the necessary resources to deliver quality education to your child. In the event of payment delays, we reserve the right to suspend or regrettably terminate a student’s enrollment. We value the trust you have placed in us and are always here to assist you. Limitation of Liability
Our Tutor will make every reasonable effort to assist the student in achieving their academic goals. However, it is important to note that individual results may vary, and specific outcomes or academic success cannot be guaranteed. Our Tutor shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use of their services. Our Tutor do not assume responsibility for the student’s overall academic performance or the student’s performance in any specific exams, tests, or assignments. Our Tutor shall not be responsible for any loss, damage, or injury, whether physical or psychological, that may occur as a result of the student’s participation in the Tutoring sessions. Our Tutor shall not be held liable for any inaccuracies, errors, or omissions in the academic content or materials provided during the Tutoring sessions. The student/parent acknowledges that our service is an educational support service and does not replace formal education or classroom instruction. Any decisions made by the Student/Parent/Guardian based on the information or advice provided by the Tutor are solely the responsibility of the Student/Parent/Guardian. Our Tutor shall not be liable for any actions or consequences resulting from the student’s failure to follow the Tutor’s instructions, recommendations, or guidance. The student/parent agrees to release and indemnify the our Tutor and the Tutoring service provider from any claims, demands, liabilities, costs, or expenses arising from their participation in the Tutoring service. It is important for the Student/Parent/Guardian to understand and acknowledge that our services and the Tutor are providing educational assistance to the best of their abilities, but the ultimate responsibility for the student’s academic performance rests with the student and their commitment to learning and the support they receive.
Termination
Either party, the Student/Parent/Guardian or our service, may terminate services offered by providing reasonable notice. Reasonable notice refers to a mutually agreed-upon period of time, typically communicated in writing or through a formal notification process. Exclusion to this notice period is for non-payment. The Student/Parent/Guardian may choose to terminate our services if they no longer require academic assistance, if they find an alternative tutoring arrangement, or for any other reason deemed suitable. Our service may terminate and has the right if the Student/Parent/Guardian fails to fulfill their financial obligations, violates the terms and conditions, engages in inappropriate behavior, or for any other justifiable reason that are note in line with these terms. Upon termination, any outstanding payments or financial obligations owed by the Student/Parent/Guardian shall become due and payable prior to the last session OR as agreed upon between both parties. In the event of termination, both the Student/Parent and the Tutoring service provider agree to handle the process in a professional and respectful manner, maintaining open communication and cooperation. It is important for both parties to understand that termination may have certain consequences, such as the discontinuation of our Tutoring sessions and the loss of access to ongoing academic support without any refund. Therefore, it is recommended that the decision to terminate our services be carefully considered and discussed between the Student/Parent/Guardian and our service to ensure the best possible outcome for all parties involved. Our terms and conditions may be updated by us at any time without notice.
